Illegal alien executed for child-rape/murder in Texas despite White House appeal
I am proud of Governor Perry and the State of Texas for making sure that justice was served last night:
Texas has executed a Mexican-born illegal alien after the US supreme court and the state’s governor, Rick Perry, spurned appeals from Barack Obama to spare the convicted child-rapist/murderer’s life in order to protect US interests abroad.
Humberto Leal Garcia was put to death by lethal injection for the rape and murder of a 16-year-old girl despite the appeals of senior diplomats, military officials and prominent politicians who said the execution could jeopardise the lives of Americans.
Shortly before Leal was led in to the death chamber in Huntsville the supreme court rejected by 5-4 an appeal from the White House to block the execution on the grounds it was in breach of an international convention governing the treatment of foreigners who are arrested and would therefore do “irreparable harm” to America’s interests. Perry also declined to exercise his power to delay the execution by 30 days. His office argued that Leal was guilty of a heinous crime and deserved to die for it.
The Texas governor is a vigorous advocate of the death penalty. He has overseen the execution of more than 200 men and is on the brink of entering the US presidential race with strong support of conservatives who back capital punishment.
Perry’s decision followed a rejection by the Texas board of pardons and paroles of Leal’s request for a reprieve or commutation of his sentence.
Leal, a 38-year-old former mechanic, was convicted in 1994 of the rape and killing of Adria Sauceda, whose battered naked body was found hours after the pair left a street party together. Her skull had been smashed in with a piece of asphalt.
After his arrest, the Texas police failed to tell Leal, who was born in Mexico but has lived in the US [illegally] since the age of two, that under the Vienna convention he was entitled to contact the Mexican consulate.
Leal’s lawyers have argued that had a material effect on whether he received the death penalty because he did not have swift access to legal representation which Mexican diplomats would have offered.
The White House asked the supreme court to put the execution on hold while Congress passes a law that would prevent Leal from being put to death along with dozens of other foreign nationals who were denied proper access to diplomatic representation before trials for capital crimes.
In a 30-page brief to the court, the administration said that carrying out the execution “would place the United States in irreparable breach of its international law obligation” under the convention.
But Stephen Hoffman, an assistant attorney general for Texas, said in a brief to the supreme court: “Leal’s argument is nothing but a transparent attempt to evade his impending punishment.”
Sauceda’s mother, Rachel Terry, told a San Antonio television station that Leal’s life should not be spared.
“A technicality doesn’t give anyone a right to come to this country and rape, torture and murder anyone,” she said.
Humberto Leal’s appellate lawyers argued that he was not informed about his right to contact the Mexican consulate upon his arrest. And for that reason, President Obama and the Mexican government wanted Texas to give Leal a stay of execution.
That’s one of the maddening things about these advocates for illegal immigration: they want it both ways. On one hand, they complain if police ask about the legal status of an arrest suspect. But in Leal’s case, they’re angry that police didn‘t ask him whether or not he was here legally.
Here’s an idea: if Obama and Mexico are so concerned that illegal immigrants might be executed for crimes they’ve committed here in America, how about they do something to stop Mexicans from illegally entering our country in the first place?
The whole consulate thing is a non-issue to me, as it was to the Supreme Court. The defense’s technicality doesn’t change the facts of the case, nor the physical evidence which lead to Leal’s conviction.
“We decline to follow the United States’ suggestion of granting a stay to allow Leal to bring a claim based on hypothetical legislation when it cannot even bring itself to say that his attempt to overturn his conviction has any prospect of success,” said the majority.
I won’t reprint all the details of the case, but suffice it to say that this crime was so savage, Leal deserved far worse than he wound up receiving. And a consulate meeting wouldn’t have changed the facts:
- Contacting the Mexican consulate doesn’t change the fact that Humberto Leal kidnapped and raped a 16-year-old girl.
- Contacting the Mexican consulate doesn’t change the fact that Humberto Leal brutally tortured Adria by penetrating her vagina with a broken stick 15 inches long with a screw at the end of it.
- Contacting the Mexican consulate doesn’t change the fact that Humberto Leal beat, bit, choked, and then crushed Adria’s skull with a 30- to 40-pound chunk of asphalt after he was done raping and torturing her.
It’s worth noting that despite the fact that Leal had been living in America as an illegal alien since age 2, he yelled “Viva Mexico” as he received his lethal injection.
Good riddance to that rabid animal. He was about 17 years overdue to receive the death penalty. My only regret is that Texas didn’t let him ride the lightning.

Yobama, STFU. This is our state, you didn’t say a damn word until just before we fried him, you trying to put that UN stuff on us, bugger off!
And if you want to get right down to it, this “illegal alien” can be defined as foreign invader during time of war. That, by the Hague and Geneva Conventions, allows for immediate execution.
Perry has to do alot more than this to make up for 12 years of suckyness. WTF is with the border. If I were gov. I would put the Texas Guard and the miitia on the border with orders to kill. And if the feds have a problem then I would put troops on the northern border as well.
Perry is a slightly more conservative version of the moderate GW bush. I won’t vote for him. But for this piece of shit wetback…. good ridence you fucking fat slob!!!!! rot in hell!
