Is the Obama administration committing a felony?
Is the Obama administration committing a felony by implementing Obamacare after it’s been declared unconstitutional?
The Daily Caller reports that Obama’s leftists are charging ahead, despite a declaratory judgment.
Obama admin vows to continue implementing health care law despite rulingObama administration officials are vowing to continue implementation of the president’s health care law “apace” despite a second ruling that the law is unconstitutional, calling the decision by Judge Robert Vinson “a plain case of judicial overreaching” well outside mainstream legal thought.
“We don’t believe this kind of judicial activism will be upheld,” said Obama spokeswoman Stephanie Cutter in a blog post published at WhiteHouse.gov.
Senior administration officials vowed implementation of the law would “proceed apace.” The Justice Department is appealing the ruling to the U.S. Court of Appeals for the 11th Circuit.
“We strongly disagree with the court’s ruling today and continue to believe – as other federal courts have found – that the [health care law] is constitutional,” said Tracy Schmaler, a spokeswoman for the Justice Department, “The department intends to appeal this ruling to the Eleventh Circuit Court of Appeals.”
Officials dismissed the ruling as the work of a rogue judge and predicted other courts wouldn’t follow Vinson in ruling the entire law void.
Thing is, until Judge Vinson’s ruling is overturned, it is still the law whether the Obama administration likes it or not. The Executive Branch must either comply with the ruling, or file an appeal and ask for a stay pending its hearing.
According to constitutional lawyer (and nationally syndicated broadcaster) Mark Levin, any government official who spends federal funds to implement Obamacare is committing a felony under Title 18 USC Sec. 641 (misappropriation of federal funds). They would also be acting in contempt of court.
Until the SCOTUS issues a final ruling, every single person who has been hired to implement Obamacare should be furloughed. To pay them even a day’s wage is a clear violation of the law.
Felony or not, I don’t anticipate seeing President Obama or HHS Secretary Kathleen Sebelius in orange jumpsuits any time soon.

Pres. Lincoln stated: "I believe the Bible is the best gift God has ever given to man." But several Bible verses are embarrassing to Pres. Obama:
Proverbs 19:10 (NIV): "It is not fitting for a fool to live in luxury – how much worse for a slave to rule over princes!"
Also Proverbs 30:22 (NIV) which says that the earth cannot bear up under "a servant who becomes king."
And Ecclesiastes 5:2-3 (KJV) advises: "let thy words be few…a fool's voice is known by multitude of words."
Although Obama is not descended from slaves, he may feel that he's destined to become a black-slavery avenger.
Or maybe an enslaver of all free citizens!
