A few observations about SCOTUS nominee Elena Kagan
Much is being said about Elena Kagan — President Obama’s nominee to the Supreme Court.
- She’s the first SCOTUS nominee in almost 40 years without ANY judicial or appellate experience. Fundraising for Harvard Law School hardly qualifies her for a seat on our nation’s highest court.
- Her nomination — despite her obvious lack of qualifications for the position of Supreme Court Justice — smacks of blatant cronyism.
- She’s anti-military (she banned military recruiters from Harvard because gays are not allowed to serve openly).
- One of the few opinions she has made public is that she is in favor of greater presidential control. Her presence on the Court could unbalance any Constitutional challenge to Obamacare.
- Another distressing opinion she has expressed is that she believes the Supreme Court’s primary mission is to “show a special solicitude for the despised and the disadvantaged.” So much for the notion of justice being blind, applied equally to everyone.
These are all very valid observations and should be thoroughly discussed before any up-or-down vote to confirm her to the court.
Another observation has been made that Kagan resembles comedian Kevin James. Although I think that’s accurate (and irrelevant), she reminds me more of The Kurgan from the 1986 flick Highlander (sincere apologies to Clancy Brown).
Regardless of her…um…appearance, does Elena Kagan possess the experience, intellect, scholarship and competence required from a lifetime position on the Supreme Court?
Judging from her mediocre record of accomplishment, that’s a BIG NO.
[Harriet] Miers’ nomination was derailed by two complaints: that her primary qualification was that she was a “crony” of the president, and that nobody knew what views she had, if any, on the vast majority of questions facing the Supreme Court. Both criticisms are just as relevant to Kagan’s potential selection.

The second criticism of the Miers nomination applies with even greater force to Kagan. As a private lawyer, Miers, after all, had a fairly good excuse for having no public views on the great legal issues of our day. For most of the past 20 years, Kagan’s job has been to both develop and publicize such views. That she has nevertheless managed to almost completely avoid doing so is rather extraordinary.

FMP, this is somewhat cruel. Kevin James, and The Kurgan may be highly offended.
Personally, I think she resembles Chaz Bono. Chaz will not be offended by that, I'm sure.
And, on a serious note…NO ONE younger than me should EVER sit on the SCOTUS. Period! I don't care if they are the most right-thinking, originalist on the planet. This guy is one year my junior…so I'm against her!
Her qualifications to be on the SCOTUS rival those of Obama to be President. And we've all seen how well THAT is turning out….
