Sharia nonsense & The Dark Knight

I was gonna blog all about the outrage of creeping sharia law in New York, but Michelle Malkin already beat me to the punch.

Which of these is a hate crime in America?
A) Submerging a crucifix in a jar of urine.

B) Burning the American flag.

C) Putting a Koran in a toilet.

Each is offensive and tasteless in its own way. But only one is a hate crime in the eyes of the law — C) — and 23-year-old Stanislav Shmulevich of Brooklyn faces jail time for it. He’s a Pace University student arrested on Friday on hate-crime charges after he threw a Koran in a toilet at Pace University on two separate occasions, according to police.

Charles Johnson at LGF has been in contact with Shmulevich. He reports that the student has been charged with two felonies, criminal mischief and aggravated harassment.

Although I’d be offended if someone flushed a Holy Bible or took a dump on the American flag, I don’t believe such disgusting expressions of free speech should be outlawed. Allahpundit has an in-depth look at the law, especially as it relates to “hate crime” legislation.

… the court seems to be equating the dicey, dubiously constitutional language in the statute about intending to “harass, annoy, threaten or alarm another person” with intent to threaten or to provoke a fight. Why do that? Because threats and “fighting words” are both exceptions to the First Amendment. If the court read the statute any more broadly, it would be arguably unconstitutional. That’s good news for Shmulevich, although the fact that this is a trial court opinion means it doesn’t have much precedential value. Essentially, he’d argue that at best flushing a Koran is tantamount to “rude and angry words,” which, per the court’s opinion, cannot themselves constitute aggravated harassment in the second degree, let alone in the first. If the ACLU wasn’t such a bunch of rods this would be a money case for them.

Personally, I think the whole idea of “hate crime” is bogus. Criminalizing opinion is literally creating thought crime and is utter bullsh*t. I may be outraged by someone’s choice in how they protest the war or how they voice their opinion about a particular religion, but I don’t think it should be outlawed unless it breaks a real law, i.e. vandalism, assault, battery, etc.

Mark Steyn has the right idea about this.

“Obviously Mr Shmulevich should have submerged it (the Quran) in his own urine, applied for an NEA grant and offered it to the Whitney Biennial.”


Since everyone else has this issue already well in hand, here’s something a bit more fun instead:

Warner Bros.’ The Dark Knight website takes you to a fictional campaign site for District Attorney, Harvey Dent. But the Joker’s already got a similar page up, titled IBelieveInHarveyDentToo.com. The page at first seems like an error unless you select all, and find the first of what will undoubtedly be a deadly series of jokes…
